By accessing or using the ClearPrice Health website, the pricing intelligence pages, or requesting a market briefing (together, the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
ClearPrice Health publishes aggregate and hospital-level pricing figures derived from federally mandated hospital price transparency machine-readable files, CMS Care Compare quality data, and related public datasets. The Service includes the public pricing-intelligence pages and any market briefing delivered in response to a request submitted through the Service.
Figures shown on the Service, including any market briefing, are informational and derived from third-party published data. They are not a guarantee, quote, or warranty of any negotiated rate, and are not a substitute for independent verification. You must not rely on any figure from the Service as the sole basis for a contract negotiation, procurement decision, or financial commitment. ClearPrice Health disclaims liability for decisions made in reliance on Service content without independent verification.
You agree not to: (a) scrape, crawl, or bulk-extract data from the Service outside of a briefing or agreement provided by ClearPrice Health; (b) misrepresent Service figures as ClearPrice Health's own guaranteed pricing or as a negotiated rate offer; (c) use the Service to violate any law or third party's rights; or (d) attempt to interfere with or disrupt the Service's operation.
The Service, including its design, analysis methodology, and original text, is owned by ClearPrice Health. The underlying government-published price transparency data is not owned by ClearPrice Health and remains subject to its original public-domain or applicable license terms.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ClearPrice Health does not warrant that figures are error-free, current, or complete — source files are self-reported by hospitals and may contain errors or omissions outside ClearPrice Health's control.
To the maximum extent permitted by law, ClearPrice Health is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or reliance on the Service, including any pricing figure used in a negotiation, procurement, or contracting decision.
ClearPrice Health may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
